Legal Position of DQ Deutsche Quarz AG

For Deutsche Quarz AG, the distinction between surface ownership and mineral extraction rights is not merely theoretical. It is directly relevant to the legal position of the Company's mining project.

Ownership and Mining Rights

According to the Mining Register (Berggrundbuch) maintained in Freiberg, Saxony, DQ Deutsche Quarz AG is registered as the owner of the mine and the associated mining rights (Bergwerksrecht). The Company's legal position is therefore based on registered mining rights and is not dependent solely upon ownership of the surface land. This is particularly significant in the historical context of mining law in the eastern German federal states, where ownership of land and ownership or entitlement to mineral resources may constitute separate legal positions.

Registered Legal Position

The Berggrundbuch provides the formal legal record of the relevant mining property and mining rights. The registration of DQ Deutsche Quarz AG therefore establishes a clearly identifiable legal basis for the Company's position in relation to the mineral deposit. For investors and project partners, this distinction is important: DQ Deutsche Quarz AG is not merely seeking access to a mineral resource located beneath third-party land. According to the Berggrundbuch, the Company holds the registered mine and the associated mining rights. These registered rights form an important legal foundation for the development of the Company's mineral resource project.

Mining Rights and Operating Permits

The ownership of the mine and the mining rights should, however, be distinguished from the regulatory approvals required for individual mining and operating activities. The registered Bergwerksrecht establishes the Company's legal position in relation to the mineral resource, while the exploration, extraction, operation, environmental management and subsequent rehabilitation of the mining area remain subject to the applicable requirements of German mining law and the relevant regulatory approval procedures.

This combination of registered mining rights and regulatory supervision under the Federal Mining Act (BBergG) provides the legal framework within which Deutsche Quarz AG intends to develop its mineral resource.
